§1 General Provisions

  1. The owner of the website operating at www.agritechteam.pl is Marcin Tomasiewicz, conducting a sole proprietorship under the brand name ROYAL DEKOR, with its registered office at: Große Seestraße 6, 60486 Frankfurt am Main, registered in the German Business Register (Gewerberegister), tax identification number (USt-IdNr): DE450567258 (hereinafter: the “Owner”).

  2. The website serves informational, educational, and commercial (offering) purposes, presenting precision agriculture solutions, IoT systems, telemetry infrastructure, and analytical dashboards for data visualization.

  3. Contact with the Owner is available via email at: kontakt@agritechteam.pl.

§2 Electronically Supplied Services

  1. Within the website, the Owner provides free-of-charge services electronically consisting of:

    • providing substantive content regarding AgTech technology (website content display service),

    • providing an interactive contact form to request an offer.

  2. The agreement for the website content display service is concluded upon entering the website and terminates when the User leaves the website.

  3. The agreement for the contact form service is concluded when the User begins filling out the form and terminates upon sending the message or canceling its submission. The User may terminate the use of the website at any time without any obligations.

§3 Technical Requirements and Security

  1. To ensure correct display of the website, a device with Internet access and a web browser supporting Cookies and JavaScript are required.

  2. The User is prohibited from providing unlawful content, attempting to interfere with the website’s source code, or taking actions that could disrupt the operation of the telemetry systems presented on the website.

§4 Intellectual Property (IP) Protection

  1. All materials on the website, including technical descriptions of VRA (Variable Rate Application — precyzyjne dawkowanie) systems, ISOBUS/CAN-bus (electronic communication standards for agricultural machinery) integration diagrams, graphics, analytical dashboard interfaces, and logos, constitute the intellectual property of the Owner.

  2. Copying or utilizing fragments of the content for commercial purposes by third parties (e.g., competing dealers and distributors) without the prior written consent of the Owner is strictly prohibited.

§5 Nature of Information and Limitation of Liability

  1. The content on the website is for informational purposes only and does not constitute a commercial offer within the meaning of Article 66 of the Polish Civil Code. It constitutes an invitation to negotiate.

  2. The analyses, forecasts, telemetry data, and recommendations presented on the website are strictly auxiliary and advisory in nature. The ultimate decision regarding agrotechnical treatments, machine configuration, and the dosage of production inputs is made each time by the User at their own risk. The Owner shall not be liable for economic decisions made based on data provided by the website, nor for their consequences.

  3. The Owner shall not be liable for short-term interruptions in website access resulting from maintenance work or technical failures independent of network infrastructure providers.

§6 Personal Data Protection (GDPR / RODO)

  1. The controller of the Users’ personal data is the Owner (Marcin Tomasiewicz, conducting business under the name ROYAL DEKOR).

  2. Data is processed solely to handle the inquiry sent via the contact form (Article 6(1)(f) of the GDPR – legitimate interest of the Controller).

  3. Detailed rules of data processing, retention periods, and User rights (access, rectification, erasure) are specified in the Privacy Policy available on the website.

§7 Complaints and Disputes

  1. Complaints regarding the operation of the website should be submitted via email to: kontakt@agritechteam.pl. The time for complaint review is up to 14 days.

  2. A User who is a consumer has the right to use out-of-court dispute resolution methods. The EU ODR platform for out-of-court electronic dispute resolution is available at http://ec.europa.eu/consumers/odr.

§8 Final Provisions and Changes to Terms

  1. The Owner reserves the right to amend these Terms and Conditions in the event of legal changes or expansion of the website’s functionalities. Amendments become effective on the day the new content of the Terms is published on the website.

  2. In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law shall apply, in particular the Civil Code and the Act on the Provision of Electronically Supplied Services.

  3. Any disputes arising between the Owner and a User who is not a consumer shall be resolved on the basis of Polish law by a Polish common court having jurisdiction over the registered office of the legal representative in Poland chosen by the Owner.

  4. In the case of Users who are consumers, any disputes shall be resolved by a Polish court with local jurisdiction according to the generally applicable provisions of Polish law (consumer’s place of residence).
